Legal1. Who we are and what these Terms cover
Thirdslot (the "Service", available at thirdslot.com) is operated by Arcane Digital Limited, a company incorporated in Hong Kong, whose registered office is at Room A03, Unit 5-11, 31/F New Trend Centre, 704 Prince Edward Road East, San Po Kong, Kowloon, Hong Kong ("Thirdslot", "we", "us").
These Terms of Service (the "Terms") govern the free audit, the creation of an account and every paid plan. By running an audit, creating an account or paying for a plan, you accept these Terms, together with our Privacy Policy, Refund Policy and Acceptable Use Policy, which form part of them.
2. Business customers
The Service is intended for businesses, organisations and self-employed professionals. By subscribing, you confirm that you are acting for purposes related to your trade, business or profession, and, if you subscribe on behalf of a company or a client, that you are authorised to bind it. You must be at least 18 years old.
Nothing in these Terms limits the rights that mandatory consumer law of your country may grant you, where such law applies despite this business-only positioning.
3. The Service
Thirdslot measures how a business is mentioned and recommended in the answers of AI assistants (for example ChatGPT, Perplexity or Gemini) or, for the SEO offer, in Google search results, for a set of questions that its potential customers ask. Depending on the plan, the Service also includes recommendations validated by an expert and the implementation of those recommendations.
3.1 Free audit
The free audit tests a set of questions once on each measured model. It is a snapshot, not a statistical measurement: AI answers vary from one request to the next. Free audits may be limited in number per day, per site or per email address. An audit report can be opened by anyone who has its link; it is not indexed by search engines.
3.2 Paid plans
- Radar: weekly visibility measurement on the tracked questions, tracking of competitors and alerts when your position drops.
- Pilot: everything in Radar, plus a set of priority actions validated by an expert each month and asynchronous questions to that expert.
- Autopilot: everything in Pilot, plus the implementation of the actions by Thirdslot, submitted to you for one-click approval, and the guarantee described in Article 9.
The exact content, quotas (questions tracked, competitors, models measured, pages analysed, actions per month) and prices of each plan are those displayed on the website or in your dashboard at the time you subscribe.
3.3 Start of the Service
The first measurement starts as soon as your payment is confirmed; a first full score is usually available within 24 to 48 hours. Measurements then take place every week.
4. Your account
You must provide accurate information when you create your account and keep it up to date. You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at [email protected] if you believe your account has been used without your permission.
You may only audit and track websites that you own or that you are authorised to represent (for example as an agency acting for a client).
5. Prices and taxes
Prices are stated in US dollars (USD), exclusive of taxes. Arcane Digital Limited is established in Hong Kong, where no VAT, GST or sales tax applies to the Service. Where the law of your country requires a tax to be accounted for on the purchase of services from abroad (for example VAT under the reverse-charge mechanism), you are responsible for declaring and paying it. If we become required to collect a tax in your country, it will be shown separately before you pay.
We may change our prices. A new price never applies to a period you have already paid for; for an existing subscription it applies from your next renewal, provided we have notified you by email at least 30 days in advance. If you don't accept the new price, you may cancel before it takes effect.
6. Billing and payment
6.1 Billing periods
- Monthly: charged on the day your payment is confirmed, then on the same day each month.
- Annual: 12 months billed in advance, at a 20% discount on the monthly price. An annual plan is a 12-month commitment.
Subscriptions renew automatically for a period of the same length until you cancel them.
6.2 Payment methods
Card payments are processed by our payment provider, Stripe. Where offered, you may also pay through PayPal and, for annual plans, by bank transfer. Thirdslot never receives or stores your full card number: it is entered on, and kept by, the payment provider, which may apply its own terms. By subscribing, you authorise us and our payment provider to charge your payment method on each renewal date.
When paying by bank transfer, your subscription starts once the funds have been received on our account with the reference shown at checkout. Bank fees and currency conversion costs are borne by you, and the amount received must cover the invoiced amount. Renewals paid by transfer are invoiced in advance and are due within 14 days.
6.3 Failed payments
If a payment fails, we will notify you and may retry the charge. If the amount is still unpaid 14 days after the due date, we may suspend the paid features of your account until payment is made, then cancel the subscription.
6.4 Invoices
An invoice is issued for every payment and is available from your dashboard.
7. Promotional and welcome offers
We may offer discounts, including a welcome offer attached to a link shared by an existing customer. Unless stated otherwise, an offer applies once per business and per website, only to new customers, cannot be combined with another offer, has no cash value and applies only to the period it describes; the regular price applies afterwards. We may refuse or withdraw an offer obtained through abuse, such as creating several accounts or using an offer on a business you already own or control.
If you take part in a programme offered in your dashboard, its specific conditions, displayed there when you join, apply in addition to these Terms.
8. Changes of plan and cancellation
Upgrades take effect immediately; the price difference for the remainder of the current period may be charged pro rata. Downgrades take effect at the next renewal date.
Cancellation: you may cancel at any time from your dashboard (Settings → Danger Zone) or by writing to [email protected]. Cancellation stops the next renewal: you keep access to the paid features until the end of the period already paid for, and you are not charged again. For annual plans, cancellation stops the renewal at the end of the 12-month period; amounts paid are not refunded pro rata. Your score history and reports remain available in your account after cancellation, unless you ask us to delete your account.
Refunds are governed by our Refund Policy.
9. The 90-day guarantee (Autopilot only)
The guarantee applies only to the Autopilot plan. The Radar and Pilot plans carry no results guarantee.
- AI visibility offer: if, after 90 consecutive days of Autopilot subscription, none of your target questions results in your business being cited by any of the measured AI models in any of our weekly measurements, we refund in full all amounts paid for the Autopilot plan (for an annual plan, the full annual payment).
- SEO offer: if, after 90 consecutive days of Autopilot subscription, none of your target questions has gained a single position in Google search results compared with the first measurement, we refund in full all amounts paid for the Autopilot plan (for an annual plan, the full annual payment).
The guarantee is subject to the following conditions:
- the Autopilot subscription has been active and fully paid throughout the 90 days;
- the "target questions" are the questions tracked for your site at the start of the 90-day period, as shown in your dashboard;
- you have given us the access we need to implement the actions (for example to your website or content management system) and have approved or rejected each proposed action within 7 days of its submission; actions you reject or leave unanswered are not counted against us;
- you have not, during the period, made changes that undo or block the actions implemented (for example removing published pages or blocking AI crawlers);
- the claim is sent to [email protected] within 30 days after the end of the 90-day period.
The guarantee may be claimed once per business and per website. The refund is made to the original payment method and ends the Autopilot subscription. Our measurements, recorded in your dashboard, are used to assess whether the conditions are met.
10. Implementation of actions and your cooperation
For the Pilot and Autopilot plans, our recommendations are based on the measurements, on the public pages of your website and on the information you give us. For the Autopilot plan, we implement only the actions you have approved. You remain the publisher of your website and responsible for its content, its compliance with the law and its backups. Where you give us access to your systems, you should create a dedicated access that you can revoke at any time; we use it only to perform the Service.
We may refuse to implement an action that would breach the law, a third party's rights or our Acceptable Use Policy.
11. Third-party services and the nature of AI answers
Measurements are made by querying third-party AI models and search engines through their official interfaces. Thirdslot does not control, and is not affiliated with, OpenAI, Google, Perplexity, Anthropic or any other provider whose results we measure; their names are used only to describe what we measure. Their answers change constantly, depend on their own systems and may differ from what a given user sees. Apart from the guarantee in Article 9, we do not guarantee any ranking, citation, traffic or revenue result.
12. Intellectual property
Our property: the Service, its software, methodology, design, texts and brand remain the property of Arcane Digital Limited or its licensors. We grant you a non-exclusive, non-transferable right to use the Service for your business during your subscription.
Your content: you keep all rights to your content and data. You grant us a licence to use them only to provide the Service.
Deliverables: reports, recommendations and content produced for you as part of the Service may be used freely by you, including after cancellation. We may use measurement data in aggregated and anonymised form, without identifying you, to improve the Service and to publish statistics.
13. Availability and disclaimer
We make reasonable efforts to keep the Service available and accurate, but it is provided "as is" and "as available". Interruptions may occur for maintenance, or because of third parties (AI providers, hosting, networks). To the extent permitted by law, we disclaim any warranty not expressly stated in these Terms.
14. Limitation of liability
To the extent permitted by law, Thirdslot is not liable for indirect or consequential losses, such as loss of profit, revenue, business, data or reputation, nor for decisions taken by third-party AI models or search engines. Our total liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud or gross negligence.
15. Indemnification
You agree to indemnify Thirdslot against third-party claims resulting from your breach of these Terms, from the content of your website or from your use of the Service for a site you were not authorised to represent.
16. Suspension and termination
We may suspend or terminate your account, after notice where reasonably possible, in case of a serious breach of these Terms or of the Acceptable Use Policy, of non-payment, or if required by law. If we terminate a paid subscription without fault on your part, we refund the unused portion of the period already paid for.
17. Personal data
We process personal data as described in our Privacy Policy. Data is never sold. Where we process personal data on your behalf as a processor, we do so only on your instructions and to provide the Service.
18. Changes to these Terms
We may update these Terms. For material changes affecting your subscription, we will notify you by email at least 30 days before they take effect. If you don't accept them, you may cancel before that date; continuing to use the Service afterwards means you accept them.
19. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Before taking any legal action, please contact us at [email protected]: we will try to resolve the matter amicably within 30 days. Failing that, any dispute is subject to the exclusive jurisdiction of the courts of Hong Kong, subject to any mandatory rule granting jurisdiction to the courts of your place of residence.
20. General provisions
If a provision of these Terms is held invalid, the other provisions remain in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your subscription without our consent. These Terms are written in English; any translation is provided for convenience and the English version prevails.
